Please read these Terms carefully before purchasing coaching services or products from this Website. 

Please note that these are general Terms and Conditions for Just Being Me. Individual programmes will have their own Terms and Conditions that will be sent as required. 

1. About Us

Jenny Field trading as Just Being Me (“we”, “us”, “our”) is a sole trader operating in England.

These Terms apply to all purchases of coaching services, physical goods, digital products and subscriptions made via our Website.

You must be at least 18 years old to purchase from us.

By placing an order or booking Services, you agree to be legally bound by these Terms.

PART A – COACHING SERVICES

2. Nature of Coaching

We provide NLP and personal development coaching services (“Services”).

Coaching:

  • Is not therapy, counselling, psychotherapy, or medical treatment
  • Does not diagnose or treat mental health conditions
  • Is not a substitute for medical or psychological advice

You confirm that:

  • You are voluntarily participating
  • You are responsible for your own decisions and actions
  • You will seek appropriate professional support where necessary

We may decline or terminate Services if we reasonably believe coaching is not appropriate.

3. No Guarantee of Results

We do not guarantee specific outcomes or results.

Results depend on your commitment, circumstances and implementation.

4. Booking and Payment

A contract is formed when we confirm your booking by email.

Fees are as stated on the Website at the time of booking and must be paid in advance unless agreed otherwise.

5. Session Cancellation Policy

  • 48 hours’ notice is required to reschedule.
  • Sessions cancelled with less notice may be charged in full.
  • Missed sessions are non-refundable.

For coaching packages, fees are non-refundable once the first session has taken place unless required by law.

6. Online Sessions

You are responsible for suitable internet access and equipment.

We are not liable for technical failures outside our control.

Sessions will not be recorded without your express consent.

7. Confidentiality

All coaching conversations are confidential.

Confidentiality may be broken where:

  • There is risk of serious harm
  • Disclosure is required by law
  • Safeguarding obligations arise

PART B – ONLINE SHOP (GOODS, DIGITAL PRODUCTS & SUBSCRIPTIONS)

8. Definitions

  • Goods – physical products sold via the Website.
  • Digital Products – downloadable or electronically supplied content.
  • Subscriptions – recurring product or membership purchases.

9. Orders and Contract Formation

Product listings are invitations to treat.

A contract is formed when:

  • You place an order
  • Payment is processed
  • You receive order confirmation

We may refuse orders prior to dispatch if necessary.

10. Prices and Payment

  • All prices are in GBP (£).
  • VAT is included where applicable.
  • Payment is taken at checkout.
  • Price changes do not affect confirmed orders.

11. Delivery of Physical Goods

Goods will be delivered without undue delay and within 30 days unless otherwise agreed.

Delivery costs are shown at checkout.

Risk and Ownership

  • Risk passes on delivery.
  • Ownership passes once full payment is received.

12. Digital Products

Digital Products are supplied upon successful payment.

You are responsible for device compatibility.

Cancellation and Digital Content

Your 14‑day cancellation right does not apply once:

  • You consent to immediate supply, and
  • You acknowledge that your cancellation right is lost once download/access begins.

By accessing Digital Products immediately, you agree to this.

13. Returns – Physical Goods

You have a 14‑day statutory right to cancel from receipt of Goods.

You must notify us within 14 days and return the Goods within a further 14 days.

Goods must be unused and in original condition.

You are responsible for return postage unless the Goods are faulty.

Refunds are issued within 14 days of receiving the returned Goods (or proof of return).

14. Faulty or Misdescribed Goods

Under the Consumer Rights Act 2015, Goods must:

  • Be of satisfactory quality
  • Be fit for purpose
  • Match their description

You have a short-term right to reject faulty Goods within 30 days.

Nothing in these Terms affects your statutory rights.

15. Subscriptions

Where you purchase a Subscription:

  • Billing frequency will be shown at checkout.
  • Payment is taken automatically.
  • You may cancel before the next billing date.

Cancellation takes effect at the end of the current billing period unless stated otherwise.

We may cancel a Subscription with reasonable notice.

PART C – GENERAL TERMS (APPLIES TO ALL PURCHASES)

16. Intellectual Property

All coaching materials, digital content, downloads, workbooks, and resources remain our intellectual property.

They are for personal use only and must not be copied, shared, resold or distributed without written permission.

17. Data Protection

We comply with UK data protection law including UK GDPR.

We act as Data Controller for your personal data.

Personal information is processed in accordance with our Privacy Policy.

18. Limitation of Liability

Nothing excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under UK law

Subject to this:

  • We are not liable for indirect or consequential loss.
  • Our total liability shall not exceed the total amount you have paid under the relevant contract.

19. Events Beyond Our Control

We are not liable for failure to perform obligations due to events beyond our reasonable control.

We aim to respond within 5 working days.

We do not currently participate in an alternative dispute resolution scheme, but you may seek independent advice regarding dispute resolution options.

21. Governing Law

These Terms are governed by the laws of England and Wales.

Disputes shall be subject to the jurisdiction of the courts of England and Wales (or Scotland/Northern Ireland where applicable).
